Your Legal Right to Compensation for a Work Injury

Health & Safety Laws rule to protect people from injuries at work and allows for compensation to be paid to injured workers. You are entitled to compensation if you can prove that the repetitive strain injury was partly or completely someone else’s fault; such as your employer.

Employers are not allowed to dismiss you or to treat you unfairly for making a work injury compensation claim. Your employer is required by law to have Employers’ Liability Insurance to provide insurance coverage for work accidents; so the compensation would be paid by an insurance company, and not your employer.

What is Repetitive Strain Injury?

Repetitive Strain Injury (RSI) can affect people in different ways, but at its worst RSI can be a debilitating condition that can have a devastating effect on both work and family life.

Repetitive Strain Injury is used as a blanket term to describe many different conditions, including Carpal Tunnel SyndromeTendonitis and Tenosynovitis. Symptoms typically appear within six months and can include:

  1. Pain, stiffness, swelling, numbness or tingling in the hands, wrists, fingers, forearms, elbows, shoulders, neck or back problems
  2. Discomfort when carrying out a particular task, which disappears when you stop
  3. Loss of strength and coordination in the hands.

Muscles often don't have enough time to recover between repeated activities. The damage done through RSI can be serious and even permanently disabling.
